Talent Showroom Terms of Use

The key points first
Joining the talent pool, being shown in the Talent Showroom and the placement itself are permanently free of charge for you. You will never be charged a fee, not even if a placement succeeds. You can end your participation at any time without giving reasons.
Your name and your current employer are never shown publicly. A full profile only goes to a company once you have explicitly approved it for that company.
§ 1 Provider and scope
(1) The provider of the Talent Showroom is Robin Wirfler Einzelunternehmung, trading under the business name "Talent Showroom", Bartningallee 9, 10557 Berlin (hereinafter "Talent Showroom"). Contact: info@talent-showroom.de.
(2) These terms of use apply to all persons who sign up to join the talent pool (hereinafter "you").
(3) Separate General Terms and Conditions apply to business clients. They create no rights or obligations for you.
§ 2 Subject matter
(1) After an internal review, Talent Showroom adds your profile to a talent pool, matches it against open mandates and contacts you when a mandate fits your profile.
(2) At your separate request, your profile is additionally shown in pseudonymized form in the Talent Showroom (§ 5).
(3) Talent Showroom provides job placement within the meaning of § 35 SGB III (German Social Code, Book III) to companies. You are not charged any remuneration and no advance payment is requested from you; no claim to remuneration against you arises under any circumstances.
§ 3 Free of charge
(1) Sign-up, review, admission, display, support and placement are free of charge for you. This also applies if a placement is successful.
(2) Talent Showroom does not ask you for advance payments, processing fees or any contribution to costs of any kind.
(3) Talent Showroom is paid exclusively by companies.
§ 4 Sign-up and admission
(1) By submitting the sign-up form, you make an offer to join the talent pool. The user agreement is concluded when Talent Showroom confirms your admission.
(2) Every profile is reviewed by a person before admission, not automatically. There is no claim to admission to the talent pool or to being shown in the Talent Showroom.
(3) Talent Showroom may decline admission without giving reasons and may remove an admitted profile from display at any time. In that case, the data you have already submitted is deleted in accordance with the periods in § 8.
§ 5 Pseudonymized display
(1) Only the following is shown in the Talent Showroom: reference code, field, state, experience range, compensation or day-rate band, employment type and availability status.
(2) In particular, your name, your previous or current employer, your exact place of residence, your exact salary and your contact details are not shown.
(3) If a filter combination in the Talent Showroom matches only very few profiles, no result is shown so that no conclusions about individual persons are possible.
(4) The legal basis for the display is your separate consent. You can withdraw this consent at any time with effect for the future without affecting your admission to the talent pool. A message to info@talent-showroom.de is sufficient.
(5) Despite pseudonymization, it cannot be completely ruled out in rare cases that third parties draw conclusions from the combination of the information shown. Talent Showroom expressly points this out so that you can make your decision under § 5 (4) on an informed basis.
§ 6 Disclosure of your full profile
(1) Your full profile, including your name and documents, is only transmitted after your explicit approval and only to the company you have approved in each case.
(2) The approval applies only to this one company and this one staffing process. Your approval is obtained again for every further transmission.
(3) Companies are contractually obliged to use your data solely for the specific staffing process, not to pass it on to third parties and to delete it once the process is completed.
(4) How and for how long a company processes your data after transmission is its own responsibility. Talent Showroom has no direct influence on this.
§ 7 Your information
(1) Please provide complete and accurate information and keep it up to date. Inaccurate information can cause a placement to fail.
(2) You confirm that you are entitled to submit the documents you upload and that they do not infringe any third-party rights.
(3) Please do not submit any information on special categories of personal data within the meaning of Art. 9 GDPR, in particular on health, religion, trade union membership or political opinions. Such information is not needed for placement and, if submitted nonetheless, will be removed.
(4) Please let us know if you are temporarily or permanently no longer available for placements.
§ 8 Freshness checks, retention period, deletion
(1) Talent Showroom asks you by email at regular intervals to confirm your profile. No login is required for this.
(2) Profiles that are not confirmed disappear from the public display 120 days after the last confirmation.
(3) Your profile is completely deleted 24 months after your last confirmation or the last contact. Before this period expires, Talent Showroom asks you by email whether you would like to remain in the talent pool; without your confirmation, your profile is deleted.
(4) You can request early deletion of your profile at any time. A message to info@talent-showroom.de is sufficient. Deletion takes place without undue delay unless a statutory retention obligation prevents it.
§ 9 No placement guarantee
(1) Talent Showroom owes diligent efforts, not the success of a placement. There is no claim to being presented to a company, to an interview or to a contract offer.
(2) Talent Showroom only gets in touch when a mandate actually fits your profile. Your profile is not sent out in bulk. If you have approved your profile for a company, Talent Showroom keeps you informed about the status of the selection process and passes on the company's feedback to you promptly, including in the event of a rejection.
(3) The decision on hiring and contract terms is made solely by the respective company.
§ 10 Term and termination
(1) The user agreement runs for an indefinite period.
(2) You can end it at any time, without notice and without giving reasons, in text form. A message to info@talent-showroom.de or unsubscribing via the personal link in an email from Talent Showroom is sufficient.
(3) Talent Showroom may end the agreement with two weeks' notice in text form. The right to extraordinary termination for good cause remains unaffected.
(4) On termination, your profile is removed from display and deleted in accordance with § 8.
§ 11 Liability
(1) Talent Showroom is liable without limitation for intent and gross negligence and for injury to life, body or health.
(2) In cases of simple negligence, Talent Showroom is only liable for breach of material contractual obligations, i.e. obligations whose fulfilment makes the proper performance of the agreement possible in the first place and on whose compliance you may regularly rely. In this case, liability is limited to the typical, foreseeable damage for this type of agreement.
(3) Statutory claims otherwise remain unaffected.
§ 12 Data protection
(1) Details on how your data is processed, the legal bases and your rights can be found in the privacy policy at talent-showroom.de/datenschutz.
(2) You have the right to access, rectification, erasure, restriction of processing, data portability and objection, as well as the right to lodge a complaint with a data protection supervisory authority.
§ 13 Changes to these terms
(1) Talent Showroom may change these terms of use insofar as this is necessary to adapt to changes in the law, case law or technical or organizational processes and you are not unreasonably disadvantaged as a result.
(2) Talent Showroom informs you of an intended change in text form at least six weeks before it is due to take effect, pointing out your right to object.
(3) If you do not object by the time it takes effect, the change is deemed accepted. If you object, the user agreement ends when the change takes effect; your profile is then deleted in accordance with § 8.
§ 14 Final provisions
(1) The law of the Federal Republic of Germany applies. Mandatory consumer protection provisions of the country in which you have your habitual residence remain unaffected.
(2) The statutory places of jurisdiction apply.
(3) Talent Showroom is not obligated and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
(4) Should any provision of these terms of use be or become invalid, the validity of the remaining provisions remains unaffected. The statutory provision takes the place of the invalid provision.
